High Court judge Justice Pisirai Kwenda has dismissed an application made by Mitchelle “Moana” Amuli’s mother Yolanda Kuvaoga to revoke a burial order issued by the Registrar of Births and Deaths designating Warren Hills cemetery as her place of burial.
Kwenda said her application failed to establish any legal basis as Kuvaoga was “basking in the perceived grandeur of the deceased’s celebrity lifestyle”.
Kuvaoga had told the court that Moana was no longer following her father’s Muslim faith as she was now leading a life of imbibing in alcohol and partying.
Her father Ishmael Amuli maintained that his daughter had not renounced her faith at anytime before her death, hence was going to be buried the Muslim way.
Kwenda said the courts may not usurp functions of the Registrar who correctly issued the burial order and there was no legal basis in cancelling it.
“The application failed to lay a legal basis to replace the burial order … Application is hereby dismissed,” Kwenda said. Nhau/Indaba
